  • Do I need to take an English test?

It depends on the country of your passport and the Education Provider that you are studying. The Education Provider usually asks for a free English test to make sure that you can understand and study without difficulty.

  • When can I start my studies?

MigrationAgents.com recommends that you apply for a course that is 4 months or more in advance to allow enough time to prepare for the visa and for Immigration Department to assess your student visa.

  • Why do I need OSHC Insurance?

International students undertaking formal studies in Australia, and their dependents (for example, spouses and children under 18 years old), must obtain OSHC Insurance. It is a requirement for student visa application and the OSHC Insurance must be purchased before lodging the student visa application.

OSHC Insurance includes cover for visits to the doctor, some hospital treatment, ambulance cover and limited pharmaceuticals (medicines). OSHC insurers can provide a range of different OSHC products. These may range from a basic product which covers only the compulsory minimum services to comprehensive products which cover, in addition to the compulsory minimum services, extra services as specified under the particular policy.

  • How can I see a General Practitioner (GP) Doctor for free (bulk bill) using OSHC Insurance?

Bulk billing is when your doctor bills Medicare Australia directly and accepts the Medicare benefit as full payment for their service. This means you do not have any out-of-pocket expenses. It is called bulk billing because the GP practice bills Medicare in ‘bulk’, that is, a collection of consultation services are billed to Medicare at the same time.

Always ask if the Clinic does “bulk bill” when you make your appointment to see a GP Doctor.

  • What is the Country of Passport that does not need OSHC Insurance?

Australia currently maintains agreements with eleven countries including: the United Kingdom, New Zealand, Ireland, Sweden, Finland, the Netherlands, Norway, Italy, Malta, Belgium and Slovenia. Overseas Students from these countries are entitled to medically necessary treatment while they are in Australia, comprising public hospital care (as public patients), Medicare benefits and pharmaceutical items under the Pharmaceutical Benefits Scheme (PBS).

  • Are you able to help me with the OSHC Insurance cover?

Yes, MigrationAgents.com m can help you issue the OSHC Insurance because it would be easier for us to help you if you need to adjust or request for refund.
Beware of fake OSHC Insurance providers online who offers very low premium that may not be accepted by the Immigration Department.
  
  • What happens if I have bought an OSHC Insurance from a fake Company?

If you have bought an OSHC Insurance from a fake Company, MigrationAgents.com is unable to assist you to ask for a refund from that Company.
You will need to provide an OSHC Insurance cover from Insurance Companies recognised by the Immigration Department meaning you may have to re-buy your OSHC Insurance again.

  • What are the extra considerations when I add a dependent to my student visa?

1.      The Immigration Department may ask for extra financial evidence such as bank statements, bank loan, evidence of asset, payslip, tax statement and etc.
2.      The OSHC Insurance are expensive for a Couple/Family OSHC cover.
3.      There may be a higher chance of refusal.
 
  • Am I able to add dependent after the student visa is granted?

  • How much financial support do I need for my student visa application?

        

        
  • Financial Sponsor Test - Occupation, Income and Asset

The Immigration Department has an Occupation, Income and Asset test for financial sponsors.
   
Immigration Department will not accept financial sponsor if they don’t have a good job, earn a good income and have asset (property). Immigration Department will always assume that the bank amount is borrowed for visa purposes unless the financial sponsor can prove that they genuinely can save that amount of money.
- An amount of AUD$ 35,000 should be reflected on a bank statement as savings.
- The bank statement should encompass a 90-day transaction history or longer.
     
  • Am I able to use our Asset to prove that we have the financial support?

Unfortunately, assets are not readily available therefore it cannot be used as financial evidence but it is still a good evidence for your Genuine Temporary Entrant (GTE) Statement.

  • What are the documents that I need to show my Offshore bank to make the payment?

1.       Education Provider Letter of Offer;
2.       OSHC Insurance quote; and
3.       MigrationAgents.com Agreement and Invoice.      

  • How much is the instalments payment scheme? Do I need to pay the whole amount of my tuition fee?

We require our Agents fee payment, OSHC Insurance and Government Student Visa application fee to be paid before we start preparing your student visa application.
For the Education provider’s tuition fee, it must be paid before we lodge your student visa application. We can send you to an education provider that offers payment plan. The Education Provider will allow up to 3 payment instalments per semester.

We need to submit your application to your Education Provider to get the letter of offer that will advise the exact fee details and refund policy. There is no obligation until you sign the letter of offer and it becomes an acceptance of offer.

  • What are the evidence that my financial sponsor needs to provide?

Your financial sponsor should provide the following evidence to support your student visa application:
1.       Financial Evidence (either):
a)       Bank Statement from parents, family members or partner.
Please refer to the calculation above regarding the minimum amount required in the bank.

Preferably, the money must be in the bank for everyday for at least 3 months before the date of the student visa application. The more money you have, the higher your chances of getting the student visa.

The Immigration Department may ask you to transfer the money to your Bank Account in Australia (Onshore students renewing student visa only) to show that you have genuine access to the funds before they make a decision on the student visa application; or
b)      Evidence of income of AUD $72,465 for the last 12 months from parents, siblings or partner’s annual income (tax documents, business documents, letter of employment, sale of land or house and etc from the person providing the financial support) and AUD$84,543 if there is a dependent Applicant).
c)       Birth certificate, Passport and National ID of the person providing the support;
d)      Birth certificate to show how you are related (if applicable);
e)       English translation for birth certificate (if applicable);
f)       ATO Notice of Assessment or Government Income Tax Statement;
g)      Financial support letter (MigrationAgents.com will help you write).

  • Why is the Genuine Temporary Statement (GTE) important?

The genuine temporary entrant criterion for Student visa applications requires the Minister to be satisfied that the applicant intends genuinely to stay in Australia temporarily, having regard to:
a. the applicant’s circumstances; and
b. the applicant’s immigration history; and
c. if the applicant is a minor — the intentions of a parent, legal guardian or spouse of the applicant; and
d. any other relevant matter.

This Direction provides guidance to decision makers on what factors require consideration when assessing the above paragraphs a to d, to determine whether the applicant genuinely intends to stay in Australia temporarily.

Decision makers must take a reasonable and balanced approach between the need to make a timely decision on a Student visa or Student Guardian visa application and the need to identify those applicants who, at time of decision, do not genuinely intend to stay in Australia temporarily.

Genuine temporary entrant requirement
All applicants for a Student visa must show they are coming to Australia temporarily to gain a quality education. The Genuine Temporary Entrant (GTE) requirement is not intended to exclude students who, after studying in Australia, develop skills Australia needs and who then go on to apply for permanent residence.

How long do I have to prepare the GTE Statement?
 
You should complete the GTE statement in less than 6 months as we agree in our Migration Service Agreement.
 
We prefer to get a good GTE than an incomplete GTE that is done in a hurry.
 
We can always change the start date of your course and your OSHC insurance.

Write a personal statement addressing the GTE requirement
As an applicant provide a personal statement in English addressing the GTE requirement. If you are not comfortable writing it in English, you can write your statement in your own language and submit a translated copy with your application.

You can provide further details of the written statement in the application form or attach a separate document with supporting documents.

MigrationAgents.com recommends that you provide supporting evidence for the information that you provide in your written statement.  Generic statements unsupported by evidence will not be weighed heavily in the GTE assessment.

Immigration Department consider your personal circumstances when Immigration Department make a decision. When Immigration Department assess whether you are a genuine temporary entrant, Immigration Department consider your situation as a whole.

Ministerial Direction 69 sets out a number of factors Immigration Department take into account when determining if you meet the GTE requirement. It is not a checklist. Immigration Department encourage you to read Ministerial Direction 69 before drafting your GTE statement. Examples of factors Immigration Department might take into account include:

Immigration Department encourage you to provide evidence or information about:

Previous study
•           academic transcripts showing qualifications achieved
•           name of the education provider(s)
•           length of study
•           certificates of attainment

Gap in previous study
•           reasons why there is a gap in your studies including where you did not maintain enrolment

Current employment
•           your current employer
•           company address
•           period of employment
•           details of your position
•           the name and contact details of someone who can confirm the circumstances of your employment

Ties to home country or country of residence
•           evidence of financial, family or social ties. You need to show you have significant incentives to return home

Economic situation in home country or country of residence
•           documents showing employment or business activities for 12 months before lodging an application
•           potential employment offers including salary and other benefits,  after course completion
•           income tax return or bank statements

Employment in a third country
Potential employment offers, including salary and other benefits, after course completion
Include as much information and evidence as possible in your GTE statement to help give us a full view of your situation. This will help us make a decision on your student visa application. Otherwise, Immigration Department might need to ask you for more information, delaying our decision on your visa application.

How Immigration Department assess your GTE statement
The GTE requirement is used to make sure the student visa program is accessed as intended. The student visa program is not a way for international students to maintain ongoing residency in Australia.
The GTE requirement helps identify applicants who are using the student visa program for motives other than gaining a quality education.

Situations in your home country (or country of residence)
Immigration Department consider your:
•           reason for not studying in your home country or region if a similar course is available there
•           ties to your home country that support an intention to return after study is finished
•           economic situation
•           military service commitments
•           political and civil unrest in your home country

Potential situation in Australia
Immigration Department consider your:
•           ties to Australia that present a strong incentive to stay in Australia
•           level of knowledge of the proposed course and education provider
•           previous study and qualifications
         planned living arrangements
•           financial stability

Value of the course to your future
Immigration Department consider:
•           if the course is consistent with your current level of education
•           if the course is relevant to past or proposed future employment in your home country or a third country
•           expected salary and other benefits in your home country or a third country obtained with your qualifications from the proposed course of study

Your immigration history
Immigration Department consider:
•           previous visa applications for Australia or other countries
•           visa refusals or cancellations
If you are a minor, Immigration Department consider the intentions of your parent, legal guardian or spouse.

  • Will you help me with the GTE Statement direction explanation (above) if I am unclear?

  • How long does it take to get a Student Visa decision?

The current waiting period for a student visa decision is between 2-4 months.

  • Will the visa decision be processed faster if I contact you daily or weekly?

No, it will not make any difference, but we may ask you to contact the Immigration Department directly and MigrationAgents.com may choose not to respond until we get an update, request or decision from the Immigration Department.

  • What will happen if I did not get a student visa decision and the COE start date has passed?

The Immigration Department will contact us to request for new COE and OSHC Insurance when they are ready to make a decision. We will help you contact your education provider and OSHC Insurance provider but in rare circumstances, you may need to pay a small difference for the insurance.

  • Should I resign from my job first?

You should not resign from your job in case your student visa application is refused.

  • Do I have to fly immediately if I get my student visa?

 
You do not have to fly immediately after getting your student visa. We can help you change your enrolment start dates if you need to provide a few weeks of notice to resign from your job.

  • What if I am unable to get the letter of reference from my Employer?

MigrationAgents.com can still lodge your student visa application if you are reluctant to inform your current Employer that you intend to study in Australia and may be leaving the position soon. It is actually better not to inform your current employer until your student visa is granted.

  • What are the general student visa conditions?

     General Student (subclass 500) visa conditions are:
a.       Maintain health insurance (visa condition 8501)
This condition means that you must maintain adequate arrangements for health insurance (generally Overseas Student Health Cover) while you are in Australia. You must not enter
Australia before your Overseas Student Health Cover has begun. You are not permitted to remain in Australia after your Overseas Student Health Cover has expired. If you are a
student from Norway, Belgium or Sweden you may not need to maintain Overseas Student Health Cover.

b.       Work limitation (visa condition 8105)
This condition means you must not engage in any work in Australia before your course of study commences unless at the time of applying for this visa, you held a substantive visa
or a bridging visa (the previous visa) and you were permitted to work in Australia during the period that the previous visa was in effect.
You also must not engage in work in Australia of more than 40 hours a fortnight when your course of study or training is in session.
The 40-hour requirement does not apply if:
● you are engaged in work that was specified as a requirement of the course when the course particulars were entered into the Commonwealth Register of Institutions and
Courses for Overseas Students; or
● you are the holder of a Student visa granted in relation to a masters degree by research or doctoral degree and you have commenced the masters degree or doctoral degree.
In this clause:
fortnight means the period of 14 days commencing on a Monday.

c.       Meet course requirements (visa condition 8202)
This condition means that you must be enrolled in a full-time course and satisfy the course requirements of your enrolment including the course level, course progress and courseattendance. Unless you are a Defence, Foreign Affairs or secondary exchange student, the course you are undertaking must be a registered course with the Commonwealth Register of Institutions and Courses for Overseas Students (CRICOS).
The course you are undertaking must give you a qualification from the Australian Qualifications Framework that is at the same level or higher level than the course mentioned
in your grant letter.

d.       Must maintain eligibility (visa condition 8516)
This condition means that you must continue to maintain your eligibility as a person who would satisfy the criteria for the grant of your visa.

e.       Maintain education for dependants (visa condition 8517)
This condition means that you must ensure that adequate schooling arrangements are maintained for your school age dependants who will be in Australia for more than three
months on the visa.

f.        Under 18 approve welfare (visa condition 8532)
This condition means that you must maintain adequate accommodation, support and general welfare arrangements. You are not permitted to change those arrangements without the
approval of your education provider. This should be in writing. You are not allowed to enter Australia before the date specified by your education provider.

g.       Inform education provider of address (visa condition 8533)
This condition means that you must notify your education provider within seven days after arriving in Australia of your residential address (if you were outside of Australia at time of
grant). In all cases, you are also required to notify them of any change to your residential address in Australia within seven days after the change.

  • What happens if my student visa is refused?

If you are:
1.       Onshore in Australia, you can apply:
a.       For a review of the student visa decision at the Administrative Appeals Tribunal (extra Agent and Tribunal fees apply)
or
b.       Request for refund of your OSHC Insurance and Course fee (depends on the refund policy on your letter of offer).
2.       Offshore, you can:
a.       Re-apply for the student visa again and address all the issues raised in your student visa decision record (extra Agent and Government visa fees apply)
or
b.       Request for refund of your OSHC Insurance and Course fee (depends on the refund policy on your letter of offer).

  • How long does my medical check lasts?

The medical check result lasts for 12 months.

  • When should I do my medical check and biometrics?

Agent will email you your biometrics and medical check referral information after the student visa is lodged. Please do not do the medical check and biometrics before your student visa is lodged.

  • Do I need to provide a prescription of my spectacles or eye lenses?
 
You should be wearing your spectacle or contact lens on your medical check day. The clinic will ask you to read the letters to make sure that you are able to study in Australia without any difficulty. You do not have to provide your lens power (diopters).

  • What happens after I complete the medical check and biometrics?

You will have to wait for the Immigration Department to assess your student visa application. It could take between 2-4 months, and I will contact you as soon as possible when I hear from the Immigration Department. Please do not contact me weekly to ask about your student visa application as we have very good tracking software that updates us daily.

  • What will happen if I fail the medical check?

If you fail the medical check, the student visa will not be granted.

You are allowed to seek medical assistance then re-apply for the medical check when you are better in the future.

  • What will happen if the start date for COE has passed and there is still no student visa decision?

MigrationAgents.com will help you change the COE date and adjust your OSHC Insurance (extra fee may apply) when the Immigration Department is ready to make a decision.

  • Am I able to apply for a visitor visa then apply for a student visa?

MigrationAgents.com does not recommend applying for a visitor visa if your intention is not for visiting in Australia. You should apply for a student visa directly if your intention is to study in Australia temporarily.

Please be aware that if the student was previously on a Visitor Visa and is now on a Bridging Visa, they will not be covered for OSHC Insurance until their Student Visa is granted.

  • Am I allowed to work if I apply for a student visa when I am in Australia on a Visitor visa?
 
The visitor visa conditions will be transferred to your Bridging Visa A therefore you will not have work rights until the student visa is granted. If the student visa is refused and you apply for a review, you will not have work rights until the student visa is granted.

  • Am I able to apply for a student visa then apply for a graduate working visa?

You are allowed to apply for any visa that you qualify as long as your intention is the same as the visa that you apply.
You must not breach the condition imposed on your current visa if you are in Australia.
 
  • What’s the difference between Certificates, Diplomas, Bachelors, Masters, and PhDs?

        

  • If I’m a college graduate in my home country, what would be the best one for me?

I suggest you start studying from Certificate III or IV level first then progress from there. The higher the qualification, the more expensive it is.

  • Am I allowed to change courses or schools in the middle of my stay?

Student must have genuine reason to change school and it depends on the National Code.

  • Are there on-the-job trainings available in the courses offered?

All student should have access to a work placement whilst studying their course if it is a requirement.

  • Am I allowed to work while on student visa in Australia?

There are currently no restrictions on work for international students. This means that international students can work before their course commences and work more than 40 hours a fortnight in any sector of the economy. These temporary measures remain in place until further notice due to the Coronavirus Pandemic that started in 2020. Students must ensure they are aware of any changes to visa conditions, including work rights. This advice may change with or without notice from MigrationAgents.com.

  • If I have a spouse/partner as a dependent with me, will they be allowed to work?

Student visa dependent will have the same work rights as their partner.

  • Is my child/dependent allowed to study in Australia as well?

Yes, but you must pay international school fees.

  • Should I create my Immi account to check on the status of my visa application?

We check our Immiaccount multiple times every working day. We do not recommend you create your own Immiaccount and import the application from our Agent’s Immiaccount. If you insist then we are no longer responsible for your application because you could receive a request and forgotten about it, wrongly click withdraw from your application, stop us from receiving updates on your application and other reasons.

  • Are you able to help me certify my original documents for my education provider?

Yes, we are able to help you certify your original documents if you mail it to us using Registered Mail.
You can also bring your original documents to our Overseas office if it is near you.

  • Importance of providing accurate information:

As a visa applicant, you must prove your identity and provide true information with your application.

The Immigration Department may refuse your visa application for failing to satisfy Public Interest Criterion (PIC) 4020 if you, or any of the members of your family unit:
 
    • is unable to prove your identity;
    • provide bogus documents or information that is false and misleading in relation to your current visa application; or
    • provided bogus documents or information that is false and misleading in relation to a visa that you held in the 12 months before making your current application.
